Baghram baggage precedent

This article leaves us short on critical points. Where were they captured before Afghanistan, and under what conditions? Since all Afghanistan or any part part has never been occupied by America, the binding laws are Afghani. Who has legal responsibility for these people? Did the government there accept responsibility? My units in Vietnam had a similar problem and were required to turn over detainees to local authority. America never occupied any of Vietnam either, so the situation is parallel in that point.
