legislating in quicksand

Under "Citizens United" a tavern wench could've been elected to fire General Washington. The winning side would've looked at Valley Forge and attributed its victory to the fact that God himself had imposed retrictions upon campaign spending. What to do about Antonin Scalia and his "originalism"? When it commissions graphs, the Congressional Budget Office commissions only those graphs that will illustrate the nation's condition by way of dollars and cents. Who can blame members of the Taliban or Al Qaeda for thinking that those Americans who've died in the war for which there is no evidence--written off, as they have been--were never among those for whom the framers envisioned life, liberty and the pursuit of happiness?
