CREDO MOBILE'S TEN MINUTE ACTIVIST NATION CRUISE SWEEPSTAKES OFFICIAL RULES NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING 1. ELIGIBILITY: The CREDO Mobile's Ten Minute Activist Nation Cruise Sweepstakes ("Sweepstakes" or "Promotion") is open and offered only to individuals who are legal residents of the 50 United States or District of Columbia who are at least 21 years of age at the time of participation. Employees, officers and directors of The Nation L.P.("Sponsor"), CREDO Mobile, Inc. Click the icon, banner, or text link to be taken to the Promotion registration page and complete the following registration fields: First Name, Last Name, E-mail Address, and Zip Code. In the designated field, share your idea--of 100 words or less--on how to Take Back The Planet. This essay can include, but is not limited to, sustainable living, progressive activism, supporting independent media, local, local activism, human rights, etc. and the best ideas (as gauged by the site's editor) may be posted at http://www.thenation.com/credo When you have completed the entry fields and check the box confirming that you have read, understand, and agree to the Promotion Official Rules, click the "submit" button, and you will receive one entry. Any submission, regardless of whether it is published on the site, will be eligible for the Sweepstakes. Once an Essay is submitted it cannot be changed, altered or modified, becomes the sole property of Sponsor and will not be returned. Correspondence and inquiries concerning the Promotion will not be accepted or acknowledged. Any Essay, which in the sole opinion of Sponsor or its designee, is deemed to be inappropriate for publication will be disqualified. Each Essay (a) must be the original and sole creation of the submitting participant, and all right, title and interest including but not limited to the copyright in any Essay, must be owned solely by the submitting participant, (b) may not have been submitted in any other competition, (c) may not have been published, (d) may not infringe upon any third party's rights, including but not limited to copyright, patent or trademarks, trade names or logos, or rights of privacy or publicity, or contain material that is or may be considered defamatory, slanderous or libelous, or portray or depict any person or entity in a false light, (e) may not violate any law, rule or regulation, (f) may not contain any virus, bugs, or other deleterious material, and (g) may not, for example but not limited to, contain profanity, defamatory statements, words or symbols widely considered offensive to individuals of certain race, ethnicity, religious, sexual orientation or socioeconomic groups, threats to any person, place, business, group or world peace; and each participant warrants and represents his/her Essay complies with all of those conditions. Any non-complying Essay will be subject to disqualification. Essays cannot contain, among other things, the trademark, trade name or logo of any third party or entity or product, cannot name, depict or describe any person (living, dead, or fictional) other than the participant, and cannot contain any material that is protected by copyright. By entering, each participant grants permission for the use of his or her Essay, and name, to be posted on the Internet (on the Web Site and any other web site) in connection with the Promotion, and the advertising, promotion, and publicity of the Promotion, and otherwise, as stated in these Official Rules located at http://www.thenation.com/credo/rules (as solely determined by Sponsor.) Publication of Essays: The editor of the Web site may post any Essay submitted on the Web site, the reason for the posting, the length of time an Essay will remain posted, or if once posted then reposted, shall be as solely determined by the Web site editor. Notwithstanding anything to the contrary, however, there is no obligation of the Sponsor or any other person or entity to post or make any use of any Essay. Entry by Mail Without An Essay: Neatly handprint your name, complete address with zip code, daytime phone number, and email address (if available) on a 3-inch by 5-inch card or piece of paper and mail it in a first class stamped hand printed envelope to: Web Promotion, The Nation, 33 Irving Place, New York, NY 10003. The outer envelope must also have your return address in the upper left front corner. Limits and Deadlines: There is a limit of 5 entries, whether by Essay or by mail, per person, address, email address or a combination thereof, per month. While a participant may submit more than one Essay in any month, multiple Essays by any participant in any month must be unique and different, as solely determined by Sponsor; and any non-unique and different entries will be disqualified. Any attempt by any participant to obtain more than the stated number of entries by using multiple or different e-mail addresses, addresses or identities or any other methods will void all of that participant's entries and that participant will be disqualified. Mail-in entries for any month must be postmarked by the first business day after the final day of the month and received not later than 5 business days thereafter. Web site entries for any month must be received and recorded by the Sponsor's Promotion computer by 11:59:59 p.m. (ET) on the last day of the month. 4. DRAWINGS: To select the potential winner for any month, on or about the eighth business day after the last business day of any month a random drawing will be conducted under the supervision of the Sponsor from all eligible entries received for that month. On or about September 8, 2008 a random drawing will be conducted under the supervision of the Sponsor from all eligible entries received to select the potential Grand Prize winner. Entries for any month will not be carried forward into any subsequent month's drawings, but all eligible entries will participate in the Grand Prize drawing. There is a limit of one monthly prize per person, address, or email address for the entire Promotion. Potential winners will be notified, by email, regular mail, or in such other manner as determined by Sponsor on or about five business days after the drawing. 5. PRIZES and ODDS: 1 Grand Prize: a trip for winner and one (1) guest on The Nation magazine's Caribbean 7-day cruise aboard the Holland America Cruise Lines MS Westerdam. Trip consists of round-trip coach air transportation from a major commercial airport near winner's U.S. home (as determined by Sponsor) for winner and guest to port of embarkation, Outside Cabin (subject to availability) double occupancy (specific cabin/deck to be solely determined by Sponsor), regularly scheduled on-board ship meals and activities, The Nation L.P.'s sponsored seminars and activities, and transportation to and from airport and port. Approximate Retail Value $4,500. Actual value will depend on final itinerary, and any difference between stated and actual value will not be awarded. Winner must be able to travel on cruise dates departing December 14, 2008 and returning December 21, 2008. Travel, accommodations and transportation are subject to cruise itinerary, availability, change, restrictions and are at the sole discretion of the Sponsor. Black-out dates may apply. All supplemental gratuities, alcoholic beverages, off-ship excursions or activities and some on-board activities and special venue meals, travel expenses, transfers, taxes, and all other expenses not specified are the sole responsibility of the winner. Winner and guest must travel on the same itinerary, and must comply with all security requirements. Each Essay will be deemed a Work Made For Hire under the Copyright laws of the United States, but if it cannot be so deemed, then each winner irrevocably sells, assigns and transfers to Sponsor, all of the winner's right, title and interest in and to his or her Essay, including but not limited to all copyright and trademark rights, which the winner may have, in the United States and worldwide, therein, for consideration, the receipt and sufficiency of which is hereby acknowledged. Upon request of Sponsor, each winner shall execute and deliver such additional instrument of sale, transfer and assignment as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the subject Essay and of the copyrights, and trademarks transferred. Should Sponsor fail to request the said additional instrument of sale, transfer and assignment, as stated, that shall not be deemed a waiver of Sponsor's rights and Sponsor may at a later time request that instrument, and the stated winner agrees to honor and comply with such request. 7.
