The real threat of a retroactive amnesty is that it could block lawsuits aimed at uncovering the truth. Punishing the phone companies for doing what they thought was the right thing is not the goal. We should follow the amnesty policies of many countries towards their police forces after overthrowing a repressive dictator: we should grant amnesty for all acts for which are admitted and publicly disclosed by some cutoff date. Acts not disclosed get no amnesty (as an incentive to assure the disclosure is complete).

The latest terrorist act they have protected us from were those dreaded body-builders buying steroids from China. Intercepting e-mail and staging a nation wide bust.
