This article focuses on allowing surrogacy contracts in the U.S. Ruling in a custody suit that pitted a "gestational surrogate" against the couple whose fertilized egg she had contracted to carry to term and deliver for $10,000, the State Supreme Court upheld the enforceability of surrogate contracts, the first such judgment to be issued by the nation's high courts. Some feminists fear that allowing women to back out of surrogacy contracts casts them as irresponsible, less than full legal adults.
