The article focuses on the book "The Transformation of American Law, 1870-1960," by Morton J. Horwitz. When socially conscious types turn their thoughts to the law, it is generally in connection with constitutional issues regarding the defense of citizens' rights against the state or other social forces, issues like the death penalty, abortion or free speech. The stream of criminal prosecution flowing through the court system rarely comes to the attention of anyone not directly affected. And most of what lawyers do does not even suggest the potential for drama of courtroom conflict, as they draw up contracts, manage divorces, manipulate the tax laws.
