The Supreme Court, 1988-89: Testing the Conservative Justices

This article focuses on issues related to Supreme Court in the U.S. The question of who would succeed Justice Lewis Powell dominated almost everything about the Supreme Court-during its 1987-88 session. The Court seethed to be on hold, and except for the independent counsel decision, Morrison vs. Olson, which upheld the legality of appointing special prosecutors, there were few big cases. Lewis Powell was probably the most powerful judge of his time. Though essentially quite conservative, as he showed in his votes on homosexuality, capital punishment, access to the Federal courts and other issues, he often voted with the liberals in crucial cases.
