The Court and the Cold War

The article analyzes two books "The Supreme Court in the American System of Government," by Robert H. Jackson and "Nine Men. A History of the Supreme Court," by Fred Rodell. These two provocative books, one by the late Justice Jackson, the other by Rodell of the Yale Law School, focuses on the issue of proper role of the Supreme Court in the U.S. These books suggests that issue is still likely to intensify as more of the repressive legislation of the cold-war era reaches in the highest court. While views of Jackson are pessimistic, Rodell presents the Supreme Court as purely a political institution.
