Church, State and the Courts

Since World War II, there has been a radical transformation of church-state relations that has passed almost unnoticed. Church and state are linked today in a whole series of federal programs. There is no need for a conspiracy theory to explain this departure from the separation tradition. It is simply that many men in many programs made pragmatic and political decisions until the principle was overwhelmed. The United States Supreme Court does not render advisory opinions and previous cases have not dealt with federal programs. Church agencies that control public funds in educational, medical or housing programs cannot be permitted to discriminate religiously or follow sectarian restrictions.
